This privacy and personal data protection policy (hereinafter the "Politique") has been drafted to allow you to learn about the practices and conditions under which Les Jardins du Sud, Limited Liability Company registered in the Trade and Companies Register of Cannes under number 451 435 010 and whose offices are located at 600 Route de la Roquette, 06370 Mouans Sartoux, France (hereinafter "Les Jardins du Sud" or "Société") collects, uses and stores your personal data (hereinafter "Données").

You will find there the different Data that we can collect and process or that you can send us when you access the site https://www.lesjardinsdusud.com (hereinafter the "Site").

The use of the entire Site is subject to this Policy.

Given the constant evolution of laws and regulations on technology and personal data protection, it is likely that this Policy will be updated.

If you are a user of the Site, you will be informed of any changes by mail.

If any of the clauses of this Policy were to be declared null and void or contrary to regulations, it would be deemed unwritten but would not invalidate the other clauses of this Policy.

This Policy applies to Data collected by collection forms that allow for:

  • Create a customer account on the Site,
  • Contact us,
  • You subscribe to the Newsletters.

It does not apply to information collected by or through sites managed by third parties; including via applications or content (including advertising) redirecting the user to the Site.

1. WHICH ARE THE DATA COLLECTED BY THE SOUTH GARDENS?

Depending on the nature and purpose of your interaction with Les Jardins du Sud (creation of a customer account, contact form, newsletter subscription) we may collect the following Data:

  • Your e-mail address will necessarily be requested on all our collection forms and more precisely, if you wish to:
    - Place an order,
    - Ask a question,
    - Subscribe to the Newsletters.
  • Data relating to your identity >such as your name, first name, e-mail address, telephone number, may be requested from you ;

4. WHO PROCESSES YOUR DATA ?

Your Data are processed by Les Jardins du Sud employees in charge of site management.

Your Data may be transmitted to any buyer or other successor in the event of a merger, assignment, restructuring, reorganization, dissolution or other sale or transfer of all or part of Les Jardins du Sud's assets due to uncertainty or bankruptcy, liquidation or other processes in which Les Jardins du Sud User Data is included in the transferred assets.

Finally, we may also disclose your Data:

  • to comply with any legal mandate, law or process, including governmental and regulatory requests
  • if we believe that disclosure is necessary or appropriate to protect the rights, property or safety of Les Jardins du Sud, its clients or other stakeholders. The Site may contain links to different social networking platforms managed on third-party servers by persons or organizations over whom > Les Jardins du Sud has no control.

5. HOM MANY TIME YOUR DATA ARE KEEPED ?

Les Jardins du Sud keeps your Data only for the time necessary for the purposes set out in Article 3.

This storage period is not the same according to the Data in question, the nature and purpose of the collection being likely to vary this period. Similarly, some legal obligations impose a specific retention period.

When you contact >Les Jardins du Sudthanks to the different contact forms, phone number, your Data will be kept for three (3) years from the last exchange with The Southern Gardensbut will be deleted.

When you have agreed to receive our Newsletters or subscribed to our Site's Newsletters, your Data will be kept until you unsubscribe from them. If you have not agreed to receive our Newsletter in this form, your Data will be kept for two (2) years.

When you have created a customer account, all Data related to your order will be kept for ten (10) years from the date of completion.

Finally, Data collected by means of cookies or tracers will be stored for up to six (6) months for cookies or tracers measuring audience and up to thirteen (13) months for others.

6. HOW YOUR DATA ARE PROTECTED?

Your Data is stored on secure servers and protected by firewalls and antivirus software.

We have put in place technical and organizational measures to ensure the security and confidentiality of your Data against accidental loss and unauthorized access, use, modification and disclosure.

Given the particularities of the Internet, however, it is impossible for us to guarantee the optimal security of information exchanges on this network.

7. WHAT ARE YOUR RIGHTS?

You just have to unsubscribe using the link in the email that sends you the Newsletter,

In accordance with the provisions of the applicable regulations on the protection of personal data, in particular the European Data Protection Regulation 2016/679 (hereinafter the "RGPD ") as well as the law of 6 January 1978 n°78-17 "Informatique et Libertés" and its amendments, you have a right of access and a right to rectify your Data.

You also have the right to define guidelines regarding the fate of your Data in the event of death.

In addition, subject to the conditions provided by the said regulations for the exercise of these rights, you benefit from:

  • A right to delete your Data ;
  • A right to limit the processing of your Data ;
  • A right to object to the processing of your Data for legitimate reasons, in accordance with the article 21 of the GDR;
  • A right to portability on the Data you have provided ;
  • Right to withdrawal of consent, where consent has been requested.

When the processing of your Data is carried out on the basis of your consent, you may withdraw it at any time. However, you acknowledge that processing operations carried out before your consent is revoked remain perfectly valid.

You also have the right to object without reason to the fact that Les Jardins du Sudprofiles based on your Data as part of sending content or communications for commercial prospecting purposes.

For the exercise of these rights, however, in accordance with Article 12.6 of the DGPS, Les Jardins du Sud, as data controller, reserves the right to ask you to prove your identity. We inform you that the data used to justify your identity will be deleted once we have answered your request.

We have one month to respond to any request regarding the exercise of your rights. This deadline may be extended by two months, due to the complexity or excessive number of requests.

8. DOES LES JARDINS DU SUD TRANSFER MY DATA OUTSIDE THE EUROPEAN UNION?

The Data collected as part of the use of the Site is hosted by 1&1 Internet, 7 place de la Gare BP 70109, 57201 Sarreguemines Cedex whose servers are located in France.

Thus, your Data is transferred within the European Union for hosting purposes.

By using the Site, you therefore agree that your Data may be transferred to these servers.
